
General conditions for rental of VAE/MTB
GENERAL TERMS AND CONDITIONS FOR RENTING ELECTRIC ASSISTED BICYCLES (EAB) AND MOUNTAIN BIKES (MTB)
Article 1 – Purpose of the Contract :
The rental of an Electric Assisted Bicycle (hereinafter referred to as EAB/MTB) with or without accessories, equipped with the basic equipment provided by La Closerie de Fronsac, referred to as "the lessor". The EAB/MTB, its accessories, and its basic equipment rented under these terms, taken individually or collectively, are referred to as "rented goods".
Article 2 – Basic Equipment of the Bicycle :
Each rented EAB/MTB is equipped with: front and rear lights, rear luggage rack, battery with key, assistance control terminal, assistance display + counter, kickstand, mudguards, bell, bag, smartphone holder, mirror. Additionally, the lessor provides a helmet, a lock, and a repair kit.
Article 3 – Obligations of the Lessee :
The rental contract is concluded with the lessee in person and is neither transferable nor assignable. The lessee must be a natural person over 18 years old and capable of riding a bicycle. Users must be at least 14 years old and at least 1.45m tall. Minors must be accompanied by a responsible adult. The lessee acknowledges that the bicycle is rented in perfect working condition and agrees to use it with care. In case of technical failure, they must present themselves at the rental point. Repairs due to normal wear and tear will be covered by the lessor, but those due to misuse will be the responsibility of the lessee.
Article 4 – Conditions of Use :
The lessee agrees to use the bicycle themselves. Lending and subletting are strictly prohibited. They are responsible for traffic violations and damages caused. The use of the EAB/MTB is allowed on roads, bike paths, and passable trails. It is forbidden to ride on unauthorized paths or outside normal usage conditions. The lessee must always lock the bicycle to a fixed support with the provided lock.
Article 5 – Ownership :
The rented goods remain the exclusive property of the lessor. The lessee is responsible for the bicycle until its return and must subscribe to civil liability insurance.
Article 6 – Commencement, Provision, and Return :
The rental takes effect upon the delivery of the bicycle. The lessee acknowledges receiving a bicycle in good condition and agrees to return it in the same condition. No refund is provided in case of early return.
Article 7 – Liability :
The lessee exempts the lessor from any liability related to the use of the rented goods, including bodily and material damages resulting from accidents of any kind. They attest to having personal civil liability insurance covering the risks inherent in the use of the rented goods, both for themselves and for the persons under their responsibility. The lessee assumes full responsibility for damages, deterioration, and theft affecting the rented goods. In case of damage, loss, or theft, the corresponding costs will be charged to the lessee according to the current rates below.

Article 8 – Deposit :
A deposit of €300 per bicycle is required (credit card imprint). This bank imprint is not cashed and will be canceled after the return in good condition. The lessee agrees that the lessor may deduct from the deposit the amounts necessary for the repair of damages and thefts, in accordance with the rates mentioned above. It is specified that the deposit does not constitute a guarantee ceiling, and the lessor reserves the right to take any additional action to obtain full compensation for their loss.
Article 9 – Assistance :
The lessee rents the EAB/MTB in perfect working condition. The lessee is responsible for repatriating the bicycle in case of breakdown. No assistance service is included in the rental.
Article 10 – Miscellaneous Provisions :
In case of non-compliance with contractual obligations, the lessor may terminate the rental immediately.
Article 11 – Dispute :
Any dispute will be submitted to the court of the lessor's registered office.
Article 12 – Definitions :

Accident: sudden event causing damage.

Theft: unexpected event resulting in the disappearance of part or all of the EAB/MTB or accessories listed in the rental contract.

Break-in: deterioration or destruction of the lock system connecting the EAB/MTB to a fixed attachment point in public space.
Article 13 – Mediation :
